Proposal to publish Crown Minerals Act 1991 Programmes' material online

The Ministry of Business Innovation and Employment (MBIE) is seeking submissions on a proposal to publish material online for the Crown Minerals Act 1991 Programmes. Submissions close 5 August 2025.

The Crown Minerals Act 1991 (CMA) is currently supported by two Programmes: the Minerals Programme for Petroleum 2013 and the Minerals Programme for Minerals (Excluding Petroleum) 2013 (known together as the Programmes).

The Programmes are secondary legislation that set out how the Minister for Resources and the Chief Executive of MBIE will exercise their powers and interpret and apply specific provisions in the CMA and associated regulations. The Programmes also provide general operational guidance.

Consultation on changes to update the Programmes was undertaken between November 2024 and February 2025. One of the changes consulted on was moving some material associated with the Programmes online. To give effect to that change, we are proposing this material be hosted on our website to ensure it is more accessible and user-friendly. This is otherwise known as ‘incorporation by reference’.

While specific material is proposed to be hosted on an MBIE website, the relevant legislation and content the material relates to would remain in the Programmes at a high level.

Material to be incorporated

  1. The full texts of the Crown Minerals Protocol Statements (CMPS).
  2. The full text of the Relationship Instrument with Ngā hapū o Ngāti Porou.
  3. The full text of the Relationship Agreements.
  4. The full text of the Resource and Energy Accords.
  5. The list of land excluded from the operation of the Programmes (currently clause 3.1 of the Minerals Programme for Petroleum 2013 and Schedule 3 of the Minerals Programme for Minerals (Excluding Petroleum) 2013). 

Reason for incorporation

Due to the number of commitments and agreements, the proposed incorporated material comprises a large volume of text. Including this material directly in the Programmes would significantly increase their length and reduce usability. Incorporation by reference allows the Programmes to remain concise while ensuring the material is fully accessible to the public.

Availability

The material is proposed to be:

  • Publicly available and free of charge online, hosted on our website.
  • If online access is not possible, the material will be available for inspection free of charge and for purchase at a reasonable cost at a location notified on our website.
